Legal Opinion on the Use of AI Software in Higher Education Contexts

On behalf of the state of North Rhine-Westphalia in the project "Ki.edu.nrw", a "Legal Opinion on Dealing with AI Software in the Context of Higher Education" was prepared and offers in it a first comprehensive legal assessment for the use of AI services, such as ChatGPT at universities: https://nbn-resolving.org/urn:nbn:de:hbz:294-97341.
In doing so, the stakeholders addressed several aspects of copyright issues and concluded, among other things, that students or users can indeed claim authorship of AI-supported texts, provided they have used a "significant amount of their own intellectual effort" (https://www.forschung-und-lehre.de/recht/rechtsgutachten-klaert-umgang-mit-chatgpt-an-hochschulen-5457) to do so. 


It explicitly advises against banning AI tools and making corresponding changes in higher education laws, instead advocating for university-specific (case-by-case) regulations. The team announces further investigations, among other things, on a constructive handling of the tools, for example in examination formats.
